A Roadmap for the Recently Laid Off

You’ve been with your company for two or three years—gone to the picnics, schmoozed your manager, won employee of the month, been on the holiday party planning committee and see yourself retiring with your company.

It’s a regular Thursday afternoon—and you get laid off. You never saw it coming.

Even though you’ve been a loyal kool-aid drinking employee for the last two or three years, when you’re laid off they don’t offer you severance, your benefits end in two weeks and you’ve already taken your two weeks of vacation for the year. It’s you vs. the world in a battle royale/cage/lumber jack strap match, and your biggest weapons are what personal items you took from your desk when you left. A photo of your wife/husband, a coffee mug and a half eaten tin of Altoids aren’t going to get you very far. Sitting in your car, you curse yourself for not being prepared for the possibilty of being laid off—something you thought would never happen. Get ready for an onslaught of feelings.

What Should You Do Now that You Have Been Laid Off?

The first thing anyone is going to ask for when you are laid off for is your resume, and it should be the easiest/quickest thing to produce. Keep your resume updated and kept in your Google Mail/Hotmail, etc. for days just like this. Every time you get a pat on the back, learn a new skill or receive a new title, update your resume. It’s hard to remember what you did two months ago, much less two years ago. Keep your resume updated! If you’ve worked with a recruiter firm before, call them and let them know that a resume is on the way. Include salary information and any other pertinent information they may need to start the job search process. Keep an open line of communication with the recruiter, and don’t spread yourself too thin among different recruiters. Find one or two firms that you really trust and stick with them. It’s OK to “fire” a firm if you feel like they aren’t working for you or are jerking you around. Call all of your friends and let them know you were laid off and are looking for a job. Personal networks provide a bevy of job leads. It’s humbling to tell your buddies that you just lost your job, but you have to make this call. Utilize online resources like Monster, Dice, Careerbuilder, HotJobs, etc. Hit your local User Groups/Chamber Meetings, etc. and hit ‘em hard. Network, network, network. If you don’t have a blog, start one. Ditto w/Twitter, Facebook, LinkedIn. Call the unemployment office or get online and register. If you think you don’t qualify, register anyway. The worst thing they can say is, “You don’t qualify.” Ask your HR representative if you have doubts. I’ve seen people wait two or three months to sign up because they were too proud to call. Get your insurance info together. Make sure you are covered and do all you can to avoid gaps in coverage. If you’ve been laid off in the middle of the month and your insurance will cover you until the end of the month, go to the doctor and dentist and get your prescriptions written for the next three months. Most doctors will oblige. Don’t take your layoff personally. It’s business. Enjoy your time off. Spend it with your family. Make breakfast for the kids, finish a home project you’ve been putting off, catch up on Oprah and relax. It’s a short-term problem, and if you are good at what you do, you’ll be back to work quickly.

I’m Laid-off, Now What Do I Do?

OK, you’ve been laid off.  Whether it is your first time ever being terminated, laid-off or fired, or not, it is generally not a good feeling.   Understood.  How you handle your new temporary situation, both mentally and actively, will be the single largest factor effecting whether you come out on top.  It is not untrue that if mentally embraced, the job termination can be the single best thing that has ever happened to your career and future.  (If you have decided you are not going to seek re-entry to the land-of-the-employee, but really think it’s time for a change for the better, consider following the lead of those who have successfully done so, the tried and true, and learning what the top business moguls consider to be the best types of businesses to build.)

 

Post-Lay-Off Unemployment Benefits

Some obvious points to keep in mind:  First and foremost, always* file for unemployment insurance with your state agency, even if you were seemingly fired for cause (meaning, “alleged” misconduct) –  unless you are fully confident that you did steal that company computer that they accused you of, then don’t bother, and leave well-enough alone.  Many people are unaware of the fact that some types of alleged misconduct, although valid reasons for termination (your employer, generally, does not even need to provide a reason for letting you go), do not rise to the legal definition of “misconduct” needed to be disqualified from Unemployement Benefits in many states.  (For instance, too many sick days oftentimes does not rise to the level of misconduct needed for one to be disqualified from Unemployment benefits.  Who knew?  Well, I did, but most others did not.)  Likewise, poor performance, if not purposeful, is likewise not a valid disqualifying reason.  Stealing, violence on the job, or overt and unreasonable insubordination, however, may be valid disqualifying reasons. Virtually every state puts their unemployment information online, and most if not all allow you to initiate the process online.  [*If you lost your job due to an inability to perform because you have a disability or medical impairment that actually prevents you from being able to perform any job on a full time regular basis, then Unemployment benefits might not be the best avenue.  You may be eligible for Social Security Disability benefits. In addition, please note that collecting Unemployment Insurance benefits is not a bar to starting a business, if that is your choice, so long as you continue to meet your obligations required to be eligible for your benefits (i.e. job search, willing and able to work, etc.) - this is particularly helpful in light of the fact that any business start up with merit will take some building time, and being able to receive your benefits will help you survive while you build your business.  Contact this author if you need more information on whether this applies to you.]

 

Severance Pay

Secondly, don’t expect an automatic severance package.  There is a misguided notion that we as employees are entitled to one if laid-off – not true.  In fact, by and large people don’t get them at all.  (Again, unless you have a written employment contract requiring your employer to provide a severance package, it is not required to do so.)  In addition, if you believe you have any legal claims against your employer (not the norm), be aware that generally, acceptance of any proffered severance package typically includes a release or waiver of any and all claims.   That being said, however, even if a severance package is not offered, you can certainly request one!  At times it is true that the squeaky wheel gets the oil.  And if a package was offered, you can certainly negotiate for more or differing terms.

 
Medical Benefits

If you had health benefits via your employment, recognize that they may very well terminate on your last day on the job.  COBRA is generally available, but the cost is a heavy burden to you as it can often be as high as 102% of the entire premium, much of which was previously paid for by your employer but will no longer be.  However, if you or anyone in your family previously covered under your employment provided medical benefits has medical issues, without COBRA, you may find it impossible to get coverage for them.  Not to mention, as we age, it is amazing how medical issues seem to readily crop up, and without medical insurance, financial ruin can very easily be the result.  Additionally, COBRA is only available, generally, for 18  months (exceptions apply), so make sure to use this time to research your private options while searching for that next job or starting out on that business opportunity you kept procrastinating about starting before.  More about this later.

 

Cardinal Rule:  Stay in Control

Although the mental shock that comes to some people after lay-off can take days to slough off, it is very important to avoid some bad habits that can crop up and take hold.  I’m talking about not treating this new situation as if it were a vacation or a period of grief – don’t sleep in until noon, don’t party like a rock star 4+ nights/week, etc.  Not only will your funds likely be tight, you really don’t know when you will next have a job or when that new business you think you may start will start seeing black.  To protect your best interests, make sure to keep your head on straight, and to do that, you need to eat right, get ample sleep (8-9 hours preferably), and get fresh air.  Lack of sleep, too many late nights and generally not taking care of yourself will inevitable wear on your psyche, which has already gone through a mental hit with the lay-off. 

 

It can also do wonders for your motivation and future success to avoid naysayers – those with negative opinions on whatever your planning may entail, tend to be amongst the most unsuccessful (personally and professionally) and unhappy – yet it is ironic how they will swiftly slice through your plans, if they are not tightly wrapped in a traditional box that they are familiar with.  Also ironically, it is the highly successful among us that will urge us to take reasonable risks, because it is only with a bit of risk that we can actually make the positive change to our financial futures that we seek and dream of.

 

Now is the time to plan out “the rest of your life”, so to speak (and such plans are always subject to adjustment, so never fear!).  If you are looking to be an employee again, then it is imperative that you start your job search immediately, like, the next day.  The economy being what it is, if you want a better job than that which you just left, you are going to have to hustle.  Get your resume updated and make sure it is professional looking and sounding.  (If you have decided that you no longer want to be an employee working for someone else, and I hope you have the foresight to at least consider this option – then, now is the time to make the move.)    And whether being an employee or a successful business-owner is your goal, you absolutely want to network.  The more people you know, the better your chances of success, either way.

 

Now is the perfect time to think outside of the box – it is actually a great opportunity to make some changes that you didn’t have the heart or strength to do while working your 40+ for the man. For those who still want to work for someone else, consider changing up what kinds of jobs you apply for  — if you seem to be otherwise qualified for a job in a different industry, and it sounds interesting, then apply for it!   If you historically worked for small business, consider working for large, and vice versa. ( And for those that always (or just recently) decided that they want to be their own boss, now is, seriously, the time, for more than 1 reason, to consider starting a business, particularly a ‘recession-proof’ business.)   Searching for an employment job outside your comfort zone or starting a business involving some new activities you are not used to will likely surprise you as to the benefits, both mentally and financially.  For job seekers, avoid taking the wrong job out of desperation unless it is a “holdover” job.  

 

If money is tight, as it invariably is for most of us when we are in your situation, consider getting a job to hold you over until the right situation comes along – this is not your dream job, so don’t expect it to be.   This is particularly helpful for those choosing to finally start and own their own business.  However, for job-seekers, it can prevent you from depleting all of your savings while looking for that dream job.  (Incidentally, being a job seeker/worker and starting your own business are not mutually exclusive possibilities - you simply must find the business that can be successfully built on a PT basis (we found just such a business, see below)  or a job that can support you sufficiently PT, while building your business full time or be willing to do two full time activities, work for the man and build that business.  Because every business takes time to be built, unless you have a big nest egg, “incoming income” is needed to live while the business is ‘building.’  (I don’t know of any highly successful people who did not burn the candle working that extra job in order to survive the ‘building’ phase of their business – except those that started with a nice financial cushion from the getgo, or a working spouse whose income sufficed, which is not the norm.)  Remember not to be upset if your ‘holdover’ job is not your dream job – that is not what you got it for!  You use it temporarily, 6 months to 2 years, tops, to help you get that business up and running!  It is a means to an end, that is it!

 

As a self-employed person, and given the current lack of employer loyalty, decent pay, available budgets, pension provisions, medical benefits and other impediments to worthy employment, I can not more strongly urge each and every person to consider starting their own business.   If you are laid-off, you are in the absolute perfect place to start. If this seems out of your realm of possibilities, banish that thought from your mind, as it is only holding you back from true success.  You just have to find the right business for you. 

For instance, as noted above, there is a unique American, but global, corporation that it is in the business of making successful business owners out of regular folks like you and me, and ensuring that ultimately the residual income from their business organizations will allow them to largely retire and enjoy life within 2-4 years (some less), if they put in at least part time consistent efforts, show a willingness to follow directions and being trained, and persevering.  If you want this corporation to establish a new business for you, for a nominal fee as far as business start ups are concerned, they will do so.   And, the minimal cost for starting this business partnership is affordable for everyone, if this is something they want.  I believe you will never find a more reasonably priced start up opportunity that provides an actual, legitimate business that you can begin to build, day 1, without further cost.  It includes  everything, including setting up your business and providing you with a team of full support, both on the front lines and back-office, complete customer support for your customers and complete representative support for you and your team.  You will be trained, at no additional expense, in all the steps you need to do with full support at every step – and if you are willing to be so trained and to follow the proven steps, you will have no choice but to reep the various types of compensation available, relatively immediately and residually.  You will be looking back and thanking your lucky stars that you got laid-off from your employer and got out of your own way — and took that first step.  (For more information on this business opportunity, call 570-234-0171)

But with a smart strategy for handling your finances, managing your time, and executing your search, you can turn what could be a full-on disaster into merely a bump in the road.       Approach the time immediately after you’ve been laid off with the same sense of purpose you felt with your job. Resist the urge to think of unemployment as the end of the world, no matter how upsetting it may be. Think of it, instead, as an opportunity to improve yourself and to make a fresh start. You can end up better off than you were before you got the ax.

The fundamental rules for surviving your job loss are simpler than you think. Read on for some tips to help you survive—and thrive—after the proverbial pink slip has been laid on your desk:

Negotiate the best possible severance package. (Hint: Don’t automatically go for the cash!) There are two keys to getting the best possible severance package. First, whether it’s the cash settlement or career coaching benefits, negotiate each item individually. This will give you more leverage. Second, decide what you want out of a severance package, without regard for the company’s policy. Many employees simply don’t know what they can ask for in their severance talks, but it pays to research this issue and give it some careful thought.

When you approach the severance issue, think of what will truly benefit you in the long term. Health insurance, for example, costs the company less than it would cost you. You can also ask for one year of career coaching and the right to select the coaching service. People often underestimate how much time it will take them to find a new job, so they accept cash for the entire settlement. The reality is the time in between jobs can be far less worrisome when your health insurance is covered and you have career coaching to help you stay positive and find a great new job. Cash may ease the pain in the short term, but it’s these other benefits that will set you up the best if you are searching for a job for a long period of time.

Don’t take it personally. Lay offs are usually the result of budget cuts and lack of business—and not a direct result of poor performance. Remember that lots of good people get downsized, and in today’s economy it’s happening more than ever. If you are the company’s most recent hire, or if your department is being cut out all together, your position can be in jeopardy regardless of how well you’ve done your job. But perhaps the most important thing to remember is that you’re being laid off because your employer is having trouble in a tough economy—which doesn’t mean that you can’t still be a valuable employee to someone else.

Seventy-eight percent of the unemployed people who belong to The Five O’Clock Club get a job whose salary is equal to or more than their previous pay. And while it’s not always possible to achieve that in our current tight economy, there are still plenty of companies that are in desperate need of quality employees. We stress this fact at The Five O’Clock Club. Remember that there is something else out there for you, and chances are, it’s a great opportunity that will improve your future.

Live as though finding a new job is your job. If you are used to showing up at the office from nine to five every day, it can be daunting to suddenly have hours of unscheduled time on your hands. You need to find a way to maintain the structure in your life and to keep some sort of day-to-day routine. A great way to do this is by using your old work hours to focus on your job search. Use that time to join trade organizations, schedule interviews, and network as much as possible.

At The Five O’Clock Club, we recommend that an unemployed person spend at least 40 hours a week on his or her search. If you do this, you’ll find that you have less time to lament your recent lay off and less time to sink into the negative thought patterns that are associated with it. Once your search pays off, you’ll be glad you quickly hunkered down and devoted so much time to finding a new job that’s right for you.

Manage your money responsibly. Whether you receive severance pay or not, the way you manage your money immediately after being laid off will determine your worry level during the foreseeable future. If a cash settlement is part of your severance package, you might be tempted to maintain your current living status while you search for a new job. However, that money can disappear quickly, especially if you are left to pay for your own benefits. Most people assume that they will find a new job within 30 days of their job loss and are surprised that it can actually take much longer. Create a budget so that you can see how long you can live off of your severance pay. To make your severance money last as long as possible, cut back on any unnecessary living expenses for the time being and get started on your search sooner rather than later.

If you didn’t receive any severance money, you’ll also want to create a post-job budget as soon as possible. Take a look at how much money you have, which bills are coming due, and what expenses you won’t be able to cut. Make sure you can pay your critical bills—mortgage, car payment, insurance—and don’t spend money on anything extra. You may have to cancel an upcoming vacation or get rid of your cable TV, but you will be glad in six month’s time that you didn’t rack up credit card debt and that your savings is still intact.

Expand your search. Just because you worked for a large corporation in a large city doesn’t mean that’s the only type of job you are qualified to do. If you are searching only in Los Angeles, for example, think of looking outside the city or even in a different state. Or if you are looking only at large public corporations, consider small or private companies.

Your personal talents can lend themselves to a variety of different job titles. You just have to be open to them. Searching for a job outside your comfort zone can sometimes open you up to some great unexpected opportunities.

Be picky. If the bills keep rolling in and your paychecks have long since stopped, it can be easy to panic and take the first job that’s offered. Don’t leap into the wrong job. It’s important that you take your time, keep your cool, and ultimately make the right decision for you.

If money is low, get an interim job. It may not be something you would want to do in the long term, but it will provide you with a steady paycheck during your job search. That way you’ll have money coming in and you will be free to keep searching until you’ve found the right job for you. Taking the wrong job and ending up being miserable could cause a string of job hops that will cost you valuable time and effort.

Start your own business. While it may not be feasible for you to start your own small business from the ground up—complete with angel investors and expensive staff members—it may be just the time for you to put your talents to work as a freelancer. Are you a prolific writer or a graphics guru? Use your business savvy to start freelancing while you’re searching for a new job. It can provide a cushion of income in between jobs and maybe even continue to supplement you once you’ve landed a new gig.

Even better, the business in the meantime will keep your skills sharp and provide great references for your résumé. And doing work in between jobs can show a potential employer that you are motivated and that your skills are desirable.

Now, more than ever, is when being proactive counts the most. We live in an economy where there are fewer jobs and more people looking for them, and the competition is tough. This is just the reality. And as hard as it may seem at the time, the more objective that you can be about your job loss, the better the end result you will create for yourself. Don’t let losing your job define who you are; let the way you handle it define who you will be.

It’s pretty clear that the economy is bad with only a few holdouts are denying it at this point. So what to do when you are on an H1B visa and you get laid off? Well first of all don’t panic. You likely have a visa that lasts for years at this point so you are NOT accruing unlawful presence even though you ARE out of status. What in the world does that mean? Well, simply put too much unlawful presence means that you will not be allowed back into the US for many years. Specifically, 180 days to 365 days of unlawful presence means that you will be barred from the US for three years should you leave and attempt to return. Anything over a year results in a 10 year bar to reentry should you leave the United States.

 

But I’m out of status so I’m accruing unlawful presence right?

 

No, not at all. The date on your I-94 rules your world. So if you still have time on your I-94 then you are not accruing unlawful presence until that date has passed.

 

GREAT! I’ll just stay!

 

Well the bad news is that you ARE deportable since you are out of status so that’s a really bad idea! Additionally, you can’t change your status to any other status once you are laid off since you are no longer in valid non-immigrant status. That means you’ll have to leave if you try to change your status.

 

So what do I do??

 

I can’t answer that question for you. However, I can say that you aren’t supposed to be here (and I would never advocate that you violate any immigration laws) BUT if you quickly find a new and appropriate H1B visa sponsor you MAY get lucky and the USCIS MAY allow you to change employers without leaving. It’s certainly happened before and, arguably, you getting laid off isn’t your fault and you and your new employer shouldn’t be punished for you getting laid off. In other words, you shouldn’t have to spend the money to leave the US, get your new H1B issued, and then reenter costing you and your employer time and money. The likely worst case scenario in this instance is the USCIS issuing you an H1B but making you leave to get your new visa stamped. But you’ll have to find an appropriate job and beg for mercy from one of the most merciless agencies in the United States!

If youre forced into a career change because of a layoff, dont panic. While it may seem the end of the world it could end up being a blessing in disguise. In fact many, especially those in middle age whove been stuck in jobs they dont enjoy because theyve built up seniority, find they ultimately welcome the forced career change. Here are some things you must do to help yourself survive the career change.

First, take stock of what you are due by your former employer and make sure you get all of it. If you are laid off unemployment compensation is your right. It may not be a lot of money many states pay1000 a month or less but its your right and its tax free. Take it. Youll generally only have to wait one week before you start getting your checks. You also have a right to the same medical coverage as you had when you were working, as long as you pay into it the sum total of what you had been paying and what your employer had been paying for you. While this might seem a hefty price youll generally find that the coverage will be a much better buy than anything you can find on your own. Dont be tempted to go without health insurance. Its far too great a risk.

The plan that allows you this coverage is called COBRA, which stands for Consolidated Omnibus Budget Reconciliation Act. Its regulated by the U.S. federal government and you can take advantage of the coverage for up to 18 months after you leave your job. Your employer is required by law to provide the coverage. It doesnt require any medical exam and you have up to 60 days from the expiration of the insurance coverage period you were paying into when you were last employed. In other words, if you paid for the month of April and were laid off April 9th, you would have until the end of June to pick up COBRA.

Many companies offer laid off employees a severance package. If you are not offered this, do ask. Your career change may involve further education and this money might be the difference between being able to go back to school or not. It may also be that your former employer will pay for an outplacement counsellor to help you with your career change.

You must strategize your career change. Take full stock of your finances and devise a plan to manage and pay your household expenses. Reduce and even eliminate any luxury items. Make smart budget decisions. Digital cable TV is far less important to your career change plans that your high speed Internet connection, for example.

Plan your job hunt and your career change wisely. It may be that an immediate job hunt is not going to be the same as your ultimate career change. You may need to take a job at least part time, or second shift, or temporarily to get by while you pursue your career dreams, expand your training and so forth. It may be that youll have to take a lower-paying job in your new field to get your foot in the door. Accept that if its necessary, and budget accordingly. Keep in mind the ultimate career change goal and look at it as the first step in the very right direction.
